1. Acceptance of Terms
By accessing or using the Aqua-Solar website, related mobile apps, devices, and services (collectively, the “Services”), you agree to these Terms of Use and our Privacy Policy. The Services are provided by Aqua-Solar, a subsidiary of RLD Resources LLC (“we,” “our,” “us”). If you do not agree, please do not use the Services.
2. Changes to Terms
We may revise these Terms at any time by posting updated terms with a new “Last Updated” date. Continued use constitutes acceptance of the revised Terms.
3. Use of Services
You may only use the Services lawfully and in accordance with these Terms. You agree not to:
- introduce viruses or harmful code;
- attempt unauthorized access;
- use automated tools without consent;
- post unlawful or misleading content;
- interfere with other users or infrastructure.
4. User Accounts
If you create an account, you must provide accurate information. You’re responsible for account security and all activity under your credentials. Notify us immediately of unauthorized access or breaches.
5. Device Data & Analytics
- Data Collection: Our devices and Services may collect technical, operational, and usage data (e.g., device performance, system logs, environmental factors).
- Data Use: We use this data to develop, improve, and personalize our products and Services, and to troubleshoot issues.

6. Intellectual Property

Users may not copy, distribute, modify, or create derivative works without written permission. No express or implied license to any Intellectual Property is granted.
7. Disclaimers & Warranties
Services are provided “as‑is” without warranties. We disclaim all implied warranties, including merchantability, non-infringement, and fitness for a particular purpose. We do not guarantee Services will be uninterrupted, error-free, or secure.
8. Limitation of Liability
To the fullest extent permitted by law, neither Aqua-Solar nor RLD Resources LLC will be liable for indirect, incidental, special, or consequential damages (e.g., loss of profits, data, or use), even if advised of potential damages. Our total liability will not exceed the amount you paid, if any, for the applicable Service in the past 12 months—or $100 if none.
9. Indemnification
You agree to indemnify, defend, and hold harmless Aqua-Solar, RLD Resources LLC, their officers, employees, and agents from any claims or losses resulting from your breach of these Terms or misuse of the Services.
10. Third-Party Links
Our Services may include links to third-party sites or services. We are not responsible for their content, privacy practices, or terms. Linking does not imply endorsement.
11. Termination
We may suspend or terminate your access for violations, at our discretion. These Terms survive termination for provisions that by their nature should continue (e.g., IP ownership, disclaimers, data use, and liability terms).
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict‑of‑law rules. You agree to resolve disputes in state or federal courts located in Bexar County, Texas.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will remain in full force and effect.
